Court rules in favour of multi-disabled destitute children in UP
The Allahabad High Court Lucknow Bench on 24 March 2009 directed the state government to show cause and file Counter Affidavit stating therein as to what steps have been taken by the state Government for care and protection of multi-disabled destitute children within three weeks.
The above direction was passed by a division bench of Hon'ble Mr Justice Pradeep Kant and Hon'ble Justice Shabihul Hasnain in a public interest litigation (PIL) filed by Saaksham Foundation an organisation sensitising and highlighting child rights issues specially for the multi-disabled destitute children [writ petition no. 2825 (M/B) of 2009]. The PIL was filed through its Director Ms Anjali Singh.
In the petition it has been stated by the counsels Mr Padmesh Jain and Mr Amit Jaiswal that while abandoned children with multidisablities have been given the right to care and protection promised to them under Article 21 in the Indian constitution not a single child of this nature has been given his right when campaigned for by Saaksham Foundation. These children have also been deprived of their constitutional right to education as provided in Article 21 A of the constitution of India.
To give an idea of the alarming incidences of abandoning children, in the last two months ie January- February 2009, more than 25 children have been found abandoned by their parents out of which 22 were girls. This petition has been listed for hearing after three weeks.
